Welcome to Oceania Appliances! These Terms of Service (“Terms”) govern your access to and use of the oceaniaappliances.com website and all related services provided by Oceania Appliances Pty Ltd. By visiting our site or purchasing from us, you (“User” or “customer”) agree to be bound by the following terms and conditions. Please read these Terms carefully. If you do not agree with any part of these Terms, you must not use our website or services.

This website is operated by Oceania Appliances Pty Ltd (ABN 85 683 123 373), an Australian registered business located in New South Wales, Australia. Throughout the site and in these Terms, the terms “Oceania Appliances”, “we”, “us” and “our” refer to Oceania Appliances Pty Ltd. The term “you” refers to any individual or entity accessing the Site. In addition to these Terms, please review our other policies referenced herein (such as our Privacy Policy, Shipping Policy, and Return & Refund Policy) as they also govern your use of our services. We reserve the right to update or amend our Terms from time to time as needed (see Changes to Terms below).

1. Use of the Site and Eligibility

By using our Site, you represent that you are legally capable of entering into a binding contract. In Australia, this generally means you are at least 18 years old, or if you are under 18, you are using the Site under the supervision and with the consent of a parent or guardian. It is your responsibility to ensure that the use of our Site is in compliance with any laws applicable to you in your location.

When using our Site and services, you agree to do so lawfully and respectfully. You must not:

  • Use the Site for any fraudulent or unlawful purpose, or to solicit others to perform or participate in any unlawful acts.

  • Attempt to gain unauthorized access to any portion of our Site or systems, or engage in any activity that disrupts or interferes with the security or performance of the Site (such as spamming, flooding, or overloading the network or infrastructure).

  • Use any automated means (e.g. bots, scrapers) to access the Site for any purpose without our express prior written permission.

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if we believe a User has violated these Terms or is engaging in any activity that is harmful to Oceania Appliances or our customers. Such termination or refusal may occur without prior notice if we determine it is necessary to protect our interests or those of others.

If you create an account on our Site, you are responsible for maintaining the confidentiality of your account login credentials and for restricting access to your devices. You agree to accept responsibility for all activities that occur under your account. Please ensure your information is accurate and up-to-date. 2. Products and Services Information

Product Descriptions: Oceania Appliances specializes in selling refurbished and pre-owned home appliances (such as refrigerators, freezers, washing machines, and related products). We make every effort to display and describe our products accurately, including details on condition, features, dimensions, and included accessories. Because these items are refurbished, there may be minor cosmetic imperfections (such as small dents or scratches) which do not affect functionality. We clearly inspect and test each appliance to ensure it is in excellent working order before sale. All significant functional or aesthetic conditions are noted in the product description to the best of our ability.

Images: Product photos on our Site are intended to represent the item offered, but in some cases they may be sample images of the same model. There could be slight variations in appearance (e.g., a different unit of the same model might have minor cosmetic differences). Colors and details may also appear slightly different in real life versus on a screen due to lighting or monitor settingsoceaniaappliances.comoceaniaappliances.com. We cannot guarantee that your device’s display of colors or details is 100% accurate to the actual product, though we strive for accuracy.

Availability: All products are subject to stock availability. Being mostly one-of-a-kind refurbished units, once an item is sold it may not be restocked (or may be available in limited quantity). Our website will indicate if a product is out of stock or unavailable for purchase. In the unlikely event you purchase an item that just went out of stock (due to simultaneous orders or inventory error), we will contact you as soon as possible to offer an alternative or issue a full refund.

Warranty on Products: Unless otherwise stated, all appliances sold by Oceania Appliances include a standard 3-month warranty from the date of purchase. This warranty covers faults or failures in normal domestic use of the appliance (see Returns and Warranty section below for more details). Any available extended warranty options or promotions will be described on the product page or at checkout. We stand by the quality of our refurbished goods and aim to ensure you have a reliable appliance.

Service and Repairs: In addition to product sales, we may offer ancillary services (such as appliance repairs or installation assistance) as described on our Site. Any specific terms for such services (e.g., scope of repair warranties, scheduling, fees) will be provided to you at the time you engage those services, and such terms are incorporated into these Terms by reference. If you have any questions about what is included with a service, please contact us before purchase.

3. Orders and Acceptance

When you place an order on our website, you are making an offer to purchase the selected product(s) under these Terms. All orders are subject to review and acceptance by us. The steps in our order process are generally as follows:

  1. Order Confirmation: After you place an order (by completing payment at checkout), you should receive an email confirmation summarizing the details of your purchase. This email confirms that we have received your order request. However, receipt of an order confirmation does not signify our final acceptance of your order, nor does it constitute confirmation of an offer to sell. We reserve the right to accept or decline your order for any reason prior to shipping/delivery.

  2. Acceptance & Fulfillment: If we accept your order, we will begin processing it. Acceptance typically occurs when we have verified payment and confirmed that the item is in stock and ready to dispatch. We may explicitly signify acceptance by sending a subsequent email stating that your order is being prepared or has shipped. In most cases, orders for in-stock items in our service area will be accepted and fulfilled promptly.

  3. Inability to Fulfill: If we cannot accept or fulfill your order, we will notify you as soon as possible (usually via email or phone). Circumstances that might lead to cancellation include: the product you ordered is unexpectedly out of stock or no longer available; we identify a pricing or description error on our Site; your provided shipping address is outside our delivery zones; or we detect potential fraud or misuse. In case of cancellation, you will not be charged, or if payment has already processed, we will issue a full refund to your original payment method.

We also reserve the right to limit quantities of a product purchased per person, per household or per order, at our discretionoceaniaappliances.com. For example, if multiple orders of a high-demand item come in from the same customer or shipping address, we may limit the number of units we fulfill to ensure fairness or prevent reselling. We further reserve the right to refuse any order that appears to be placed with the intent to resell or distribute without authorization, or that otherwise appears fraudulent or suspicious.

Customer Information: You agree to provide current, complete, and accurate purchase and account information for all orders made via our Site. This includes ensuring the accuracy of your shipping address, email, phone number, and billing information. We are not responsible for delays or non-delivery resulting from incorrect information you provide. If you realize there’s an error in your order details after placing it, please contact us immediately (by phone or email) so we can try to correct it before shipment.

Once an order has been placed and accepted, you cannot make changes or cancellations unless agreed by us. If you need to change or cancel an order, contact us as soon as possible and we will advise if it’s feasible (if the item has not yet been dispatched, we may be able to accommodate changes).

4. Pricing and Payment Terms

All prices on our Site are listed in Australian Dollars (AUD). Unless otherwise indicated, prices include GST (Goods and Services Tax) as applicable under Australian tax law. We strive to ensure accurate pricing across our website; however, in the event of a pricing error (e.g. an item inadvertently listed at an incorrect price), we reserve the right to correct the error and revise your order accordingly (or cancel the order if necessary). If the correct price is higher than what you paid, we may contact you to confirm if you want to proceed at the correct price or cancel for a refund. We will not charge you the higher price without your consent. Pricing is subject to change without notice, but changes will not affect any order you have already placed and we have accepted.

Payment Methods: We offer secure payment options to make your purchase convenient and safe. Accepted payment methods typically include major credit and debit cards (Visa, MasterCard, American Express, etc.), as well as digital payment options such as Google Pay or other providers as listed at checkout. All online payments are processed by our trusted third-party payment processors (for example, Shopify Payments or Stripe). These processors comply with strict security standards (PCI-DSS) to ensure your payment information is protected.

When you provide payment details at checkout, you represent and warrant that you are an authorized user of the card or account. The charge will occur at the point of purchase (when you complete checkout). If your payment is not successfully processed (due to card decline, insufficient funds, or otherwise), your order may be suspended or canceled. We do not store your full credit card number or bank account details on our servers. We do not charge any surcharge for credit card payments, but your bank or card issuer might impose fees (such as foreign transaction fees if you are purchasing from outside Australia, though note we currently only ship within NSW).

Security of Payments: Our checkout process is encrypted via SSL/TLS to protect your financial information. Credit card data is transmitted directly to the payment gateway and is not visible to us. Please note that for your security, our payment processor may implement fraud-prevention measures. On occasion, this might involve contacting you to verify some details or requiring additional confirmation if an order triggers certain alerts.

Once payment is confirmed and an order is accepted, we will proceed to fulfillment (see Shipping and Delivery). If we issue any refund (e.g., due to order cancellation or a return being approved), it will be processed to the same payment method originally used, within a reasonable timeframe. Depending on your bank, refunds might take several business days to reflect in your account.

5. Shipping and Delivery

We offer delivery services for our appliances as outlined in our Shipping Policy (which is hereby incorporated into these Terms). Below is a summary of key points regarding shipping and delivery:

  • Service Area: Oceania Appliances currently delivers to New South Wales (NSW), Australia. We primarily serve the Sydney Metropolitan Area (where delivery is free of charge)oceaniaappliances.com. We also deliver to certain other regions in NSW (such as Central Coast, Newcastle, Wollongong, Blue Mountains, etc.) for an additional fee that covers the longer distanceoceaniaappliances.comoceaniaappliances.com. At this time, we do not ship or deliver outside of NSW. If your provided address is outside our serviceable area, we will be unable to fulfill the order and will inform you as such (any payment collected will be refunded).

  • Delivery Scheduling: Once your order is ready for dispatch, our team will contact you (usually by phone or email) to schedule a delivery date and time window. We deliver 7 days a week, typically between 9:00 AM and 9:00 PM, to offer flexibility in schedulingoceaniaappliances.comoceaniaappliances.com. You or another responsible adult must be present to receive and sign for the appliance at the agreed delivery time. If no one is available at the arranged time, a re-delivery fee may apply for subsequent attempts (as detailed in our Shipping Policy).

  • Delivery Conditions: We deliver large appliances to the ground floor of your address by default. If the item needs to be moved up or down stairs or into specific placement in your home, please inform us in advance – we typically require that you (or someone you arrange) assist the driver if there are stairs or difficult accessoceaniaappliances.com. Our delivery personnel will take reasonable care when handling your appliance. It is your responsibility to ensure the pathway to the delivery location is clear and safe (remove obstacles, secure pets, etc.). If our team determines that the delivery area is unsafe or inaccessible, we may need to reschedule or adjust the delivery arrangements.

  • Risk and Title: Title (ownership) of the product passes to you once you have paid for it in full and it is delivered to your address. At the point of delivery (or attempted delivery), the risk of loss or damage to the product passes to you. This means you should ensure someone is present to receive the item, and that once delivered, you take steps to protect it. We recommend inspecting the appliance upon delivery. If you notice any significant damage that appears to have occurred during transit, please inform the delivery driver and us immediately so that we can address it (e.g., by filing a claim with the courier or arranging for repair/replacement as appropriate).

  • Delivery Times: We strive to deliver within the estimated timeframe discussed when scheduling. However, delivery times are estimates and not guaranteed. Unexpected delays can occur due to traffic, weather, or high demand periods. We will communicate with you and do our best to meet the agreed window, but we are not liable for minor delays or any loss arising from a delayed delivery. If a delay occurs, we will work with you to reschedule if needed.

  • Third-Party Couriers: In some cases, we may use third-party freight or courier services for deliveries (particularly for areas outside Sydney Metro). When we do, our responsibility is to hand over the appliance in good condition to the courier. The courier then assumes responsibility for transport. We will provide you with any tracking information available. While we package and secure items carefully, if any damage occurs in transit via a third-party, we will assist you in resolving the issue, but such damage may be subject to the courier’s terms (see also our Return & Refund Policy section on Delivery Damage). We recommend you notify us of transit damage immediately on receipt, so we can help coordinate a solution.

6. Returns, Refunds and Warranty

Your satisfaction is important to us. We have a dedicated Return, Refund & Warranty Policy which explains in detail how we handle faulty products, repairs, replacements, and refunds. The following is a summary of key points, but if you need more information, please review the full policy on our website (or contact us for a copy):

  • No Change of Mind Returns: Because our products are refurbished appliances and each piece is unique, we do not generally accept returns or offer refunds if you simply change your mind or decide you no longer want the product after purchase. Please choose carefully and feel free to ask us any questions before purchasing. We are happy to provide additional details or photos if you need more information to make an informed decision.

  • Faulty or Not as Described: If the appliance you purchase is faulty or not working as promised, we take responsibility for making it right. “Faulty” means a failure or malfunction that was not disclosed and that affects the normal use of the product (for example, the fridge does not cool, or a washing machine does not spin). Minor cosmetic issues or wear-and-tear that do not affect functionality (like a small scratch or dent) are not considered faults that qualify for return, especially since these are pre-owned goods and may have some cosmetic imperfections.

  • Warranty Coverage (3 Months): All appliances come with a standard 3-month warranty from the date of purchase (unless otherwise stated in writing). During this warranty period, if your appliance encounters a problem or defect in normal use, contact us and we will arrange to inspect and repair it at no cost to you. In most cases, issues can be resolved by our technicians. We are entitled to a reasonable timeframe to diagnose and fix the issue (typically up to 2-3 weeks, as per Australian Consumer Law guidelines for repairs)oceaniaappliances.comoceaniaappliances.com. Please cooperate with us during this process – many problems can be fixed quickly and we aim to minimize any inconvenience.

  • Replacements: If a fault occurs within the warranty period and cannot be repaired within a reasonable time or cost, we will offer you a replacement appliance of similar type, age, and valueoceaniaappliances.com. The exact brand or model may differ, but it will be comparable in features, capacity, and overall condition. We will coordinate with you regarding delivery or pickup of the replacement. The warranty continues to apply from your original purchase date (or we may extend it for the replacement at our discretion).

  • Refunds: A refund is typically a last resort. We will issue a full refund only if (a) the product has a major fault that cannot be repaired or remedied with a replacement, or (b) we are unable to repair or replace within a reasonable period, or (c) another scenario as required by Australian Consumer Law (e.g. a major failure, see below). Refunds, if approved, will be processed back to your original payment method and we aim to do so within 14 business days after the decisionoceaniaappliances.com.

  • How to Make a Claim: To initiate a warranty claim or report a fault, please contact us as soon as possible after discovering the issue. Ideally, notify us within 5 days of noticing the problemoceaniaappliances.com. You can reach us via phone or email (see Contact Information below). Provide your order details (receipt or order number) and a description of the issue. We may ask for additional information (photos of the appliance, description of the fault, etc.) or arrange an inspection. In some cases, we may send a technician to your location to inspect/repair, or we may arrange to bring the item back to our workshop. We will advise the best course upon hearing from you.

  • Conditions Not Covered: Our return/warranty policy does not cover certain situations, including:

    • Change of Mind: As noted, returns because you changed your decision or found a better deal elsewhere, etc., are not accepted.

    • Cosmetic Wear: Minor scratches, dents, discoloration, or general wear that doesn’t affect performance (especially common in pre-owned items) are not coveredoceaniaappliances.com. We ensure the appliance is functional, but superficial imperfections are to be expected with refurbished goods.

    • Misuse or Damage Caused by Customer: If the appliance is damaged or malfunctions due to misuse, improper installation, unauthorized repairs/modifications, or not following the operating instructions, such issues are not covered. For example, overloading a washer beyond its capacity, or damage from dropping the appliance, would void the warranty. The product should be used as intended for normal household purposes.

    • External Events: Damage resulting from external events after delivery (e.g., electrical surges, flooding, fire, or other external factors unrelated to a product fault) are outside the scope of our warranty. Please ensure you have proper home protection measures; we cannot be responsible for such events.

  • Your Responsibilities: You are responsible for providing a safe environment for any needed repair or inspection (if a technician comes on-site), and for ensuring the appliance is accessible. You should also back up or secure any data/settings if applicable (though for appliances this is usually not relevant except maybe saving user settings). Ensure the appliance is used and maintained as per guidelines – for example, cleaning filters, not blocking vents, etc., as improper maintenance could lead to issues not covered by warranty.

Australian Consumer Law: Nothing in these Terms or in our Return & Refund Policy is intended to exclude, restrict, or modify the consumer guarantees and rights you have under the Australian Consumer Law (ACL). As a consumer, you are protected by statutory guarantees which ensure, for instance, that products are of acceptable quality, fit for purpose, and match their description. Our warranty and returns policy operate in addition to those legal rights, not in place of themoceaniaappliances.com.

In accordance with the ACL, our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The exact remedies depend on whether the issue is major or minor under the law. We fully comply with all ACL requirementsoceaniaappliances.com, so rest assured that you will not be worse off by buying from us versus any other retailer. 7. Limitation of Liability

To the fullest extent permitted by law, Oceania Appliances (including our directors, officers, employees, and agents) shall not be liable for any indirect, incidental, special, or consequential losses or damages arising out of or in connection with your use of our Site or purchase of our products. This includes, for example:

  • Any loss of profit, loss of revenue, loss of goodwill or business reputation, or loss of data.

  • Any damage to property or personal injury resulting from the use or inability to use an appliance (except to the extent that liability for personal injury or property damage may not be excluded by law).

  • Costs of procuring substitute goods or services, or any other intangible losses.

  • Any loss or damage caused by delays in delivery or inability to use the product while awaiting repair.

  • For clarity, if an appliance fails, we will cover the repair/replacement of the appliance per our policy, but we are not liable for other consequences of the failure. For example, we are not responsible for food spoilage that might occur due to a fridge fault, or water damage to your floor from a washing machine leakoceaniaappliances.com, or any inconvenience or time lost as a result of dealing with a product issue.

In any case, our total liability to you for any claim arising out of or relating to these Terms or a purchase shall not exceed the amount you paid for the product in question. This limitation of liability applies whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other basis, even if we have been advised of the possibility of such damage.

No Warranty for Website Content: While we endeavor to ensure that the information on our Site is accurate and current, we provide our website and its contents on an “as is” and “as available” basis, without any warranties or guarantees of any kind, either express or implied. We do not guarantee that the content (including product descriptions, pricing, or other information) is free from errors or omissionsoceaniaappliances.com. If we find an error or inaccuracy, we reserve the right to correct it (including after you have submitted an order). We also do not warrant that the Site will be uninterrupted, secure, or free of viruses or other harmful components. Australian Consumer Law Notice: Nothing in this section or elsewhere in these Terms is intended to exclude or restrict the application of certain guarantees, warranties, rights or remedies provided by the ACL or other applicable laws that cannot be excluded, restricted, or modified by agreement. If any guarantee or warranty is implied by law and cannot be excluded, then to the extent permitted by law, our liability for a breach of such a guarantee/warranty is limited, at our option, to either (a) re-supplying the relevant goods or services to you, or (b) paying the cost of having the goods or services re-supplied.

You acknowledge that you use our Site and purchase products at your own discretion and risk, and that you understand the limitations of liability and warranties as set out above.

8. Intellectual Property

All content on the oceaniaappliances.com Site, including but not limited to text, descriptions, product listings, photographs/images, logos, graphics, button icons, videos, audio clips, downloads, and software, is the property of Oceania Appliances Pty Ltd or our content suppliers and is protected by intellectual property laws (such as copyright and trademark laws). The compilation of all content on this Site is the exclusive property of Oceania Appliances.

  • Trademarks: “Oceania Appliances” and our logo are trademarks or service marks of Oceania Appliances Pty Ltd. All other trademarks, product names, and company names or logos used on the Site are the property of their respective owners. Nothing in these Terms or on our Site grants you any license or right to use any trademark displayed on the Site without the owner’s prior written permission.

  • Copyright: You may electronically copy or print portions of the Site for your personal, non-commercial use in order to facilitate a purchase or to learn about our products. Any other use of the Site content, including reproduction for purposes other than those noted above, modification, distribution, republication, or display of the content, without our prior written permission, is strictly prohibited.

  • User Content: If we allow users to post reviews, comments, or other content (user-generated content), and you choose to submit such content, you grant Oceania Appliances a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, publish, translate, and display that content throughout the world in any media. We reserve the right to monitor, edit, or remove user content that violates these Terms or is offensive or illegal. You are solely responsible for the content you publish and you must not post anything that infringes others’ rights or that is defamatory or unlawful.

Please respect our intellectual property and that of others. Unauthorized use of our intellectual property may result in termination of services and possible legal action.

9. User Conduct and Prohibited Activities

You agree that you will not misuse our Site or services. Specifically, you must NOT:

  • Harass, abuse, insult, harm, defame, or intimidate others via the Site (for example, in reviews or communications). Any obscene or abusive language or hate speech is strictly prohibited.

  • Bypass or attempt to bypass any security measures we use to protect the Site and our users’ data.

  • Attempt to reverse-engineer or extract the source code of any software provided on the Site.

  • Use the Site to advertise or promote third-party products or services without our written permission.

We do not endorse or assume responsibility for any third-party websites, information, materials, products, or services. If you visit or use them, you do so at your own risk and you should review their terms and policies.

For instance, if we have a link to a financing option or insurance plan offered by a partner, any arrangement you enter with that partner is strictly between you and them, even if we facilitate the introduction. Similarly, if you engage with us on social media or via a platform like Facebook or Instagram, your interactions are also governed by those platforms’ terms of use.

However, if you have feedback regarding third-party links on our Site (for example, if a link is broken or the content is inappropriate), we welcome your input so we can consider removing or updating such links.

11. Privacy

By using our Site or making a purchase, you acknowledge that you have read our Privacy Policy and understand how we collect, use, and share your information. 12. Termination

These Terms are effective unless and until terminated by either you or us. You may terminate this agreement at any time by discontinuing use of our Site and services and (if you have an account) notifying us that you wish to deactivate your account.

We may terminate or suspend your access to our Site (or any part of our services) at any time, without prior notice, if we reasonably suspect that you have violated any provision of these Terms or engaged in unlawful behavior. We may also terminate service to users who repeatedly infringe intellectual property rights or engage in fraudulent activities.

Upon termination by either party for any reason: (a) your right to access or use the Site will immediately cease; (b) if you have outstanding orders that have not been fulfilled, we may cancel them and issue refunds as appropriate, or if they have been fulfilled, our other policies (like warranty) may still apply post-termination for those transactions; (c) the provisions of these Terms which by their nature should survive termination shall continue to apply (such as Limitation of Liability, Governing Law, etc.).

Termination of access or account does not waive or affect any rights or liabilities that either you or we have accrued up to the date of termination.
